Was it a Mistake or False Imprisonment?
What's a Tuesday without a Courtroom Drama ☺️
Bar. Egbami (exclamaing in a fit of rage)"I would not be surprised she was eh eh on her phone, in the BATHROOM to be that distracted."
Bar. Ako: “With respect to the Courts jurisdiction, Your Lordship, my client has been emotionally devastated since she was locked up in the bathroom by her roommate for over two hours, restricting her movement totally as she could not escape as in Wright v. Wilson.”
“It was not until another roommate sought to use the bathroom and she heard the locks open did she come to realise as she too was about to come out.
She therefore pleads for damages and seeks an injunction for false imprisonment.”
Justice George ( nods in interest) : The defendant may open her case.
Bar. Egbami (mouth agape): “Your Lordship, I can't bear to understand how my client is at fault here.”
(Looking around the court in shock)
“She was simply unaware that her roommate had decided to sleep or bear triplets in the bathroom and now the Plaintiff wastes the time of the court by virtue of their own carelessness.”
“I would not be surprised she was eh eh on her phone, in the BATHROOM to be that distracted. And worst of all she has suffered no harm!
We therefore humbly plea the court to rule in our favour and payment for the court proceedings.”
Justice George (smirking): "I have heard all that has been said but simply being unaware does not alleviate your fault "
(Still looking towards the defendant)
"Also, the fact that the Plaintiff was unaware of the restriction at the time it occurred does not remove your liability as in Meering v. Graham White Aviation neither does lack of harm, as we're all aware that false imprisonment which is a type of trespass is actionable per se. It was also not an unavoidable situation/ an act of God, hence not a mistake.
It is only trite law then that you're liable of false imprisonment.
(Carefully looking through his files)
“You'll have to pay nominal damage of #5000 and avoid tampering with the bathroom doors while others are in use of it.”
